Dear Community Development Department and Tazewell County Board members,  

It is my request that this email is shared with all Tazewell County Board members.  

I am submitting this in response to the public engagement meeting for the Wind and Solar Ordinances updates. I support the efforts of UCTC and encourage you to look at all you can do to protect the citizens of this county. I understand that you must be compliant with the State Standards under Public Act 102-1123. Due to the already limited protections under this act, I encourage Tazewell County to maximize the setbacks allowed, minimize the noise and shadow flicker, and protect our property rights to the fullest extent possible.  Furthermore, I urge Tazewell County to continue to stand behind their statement condemning the state for the passage of Public Act 102-1123  and work with other counties to seek improvement at the state level.  

I support the previous changes made to the ordinance, including the Lasalle/Sinclair Factors and decommissioning improvements. Please protect the county and all taxpayer dollars from any liabilities should the decommissioning funds be insufficient.  

Below is a list of improvements I would like to see incorporated into the Tazewell County Ordinance:

  • Current insurance liability limits are inadequate and need to be increased to at least 10 million per occurrence and 50 million annual aggregate.

  • Reducing the flashing red lights at night by requiring Aircraft Detection Lighting System (ADLS).

  • Increased publication efforts - Public participation is necessary for a meaningful and successful ZBA hearing. An educated and informed public requires transparency. Please notify ALL landowners/homeowners within the footprint of a wind project.

  • Independent Certified Inspectors - ALL inspections must be done by a certified independent company, including but not limited to: construction completion compliance, noise levels, shadow flicker, interference, ice risk management and decommissioning. All inspections should be done at regular intervals to ensure compliance is maintained. 

  • If at any time throughout the life of the project, the noise levels are not in compliance, the applicant or facility owner will immediately shut off all the turbines until the county approves a solution after a hearing at the ZBA.

  • Current interference language is vague and provides no preventative measures. Language should be added to establish the baseline status of all RF/EMF, satellite, and internet transmissions and interference in the area prior to the installation of turbines.

This list is not all inclusive. Other items suggested by UCTC are still important. It is critical we pay extra attention to the details and definitions.   A new project such as wind and solar should put no additional burden on the county or its citizens.
